American Disabilities Act (ADA) Summary

ADA Website Compliance 42 U.C.C Sections 12101 to 12213

Title III: Nondiscrimination on the basis of disability by public accommodations.

  • Prohibits discrimination based on disability in places of public accommodation.
  • A place of public accommodation is defined as a privately operated facility whose operations:
  • Affect commerce.
  • Fall within at least one of twelve qualifying categories.


Why does it matter if a Hotel’s Website and Mobile Application Comply with Title III?

If your website is not ADA compliant you may be liable for:

  • The opposing parties' attorney's fees. 
  • Additional funds owed to the plaintiff. 
  • The development costs of making the website ADA compliant (and the DOJ or court may hold the Hotel to a higher standard than if the company was independently compliant).  

The World Wide Web Consortium (W3C)

The W3C is a non-governmental organization that provides international standards for web content accessibility.

  • 1999: Created the Web Content Accessibility Guidelines (WCAG). 
  • 2008: Released updated WCAG 2.0 Standards (more information on next slide). 
  • 2018: Released updated WCAG 2.1 Standards. 
  • WCAG 3.0 anticipated in next few years.

  

The courts and the DOJ have often relied on the WCAG for determining if a website violates Title III; and as the standard a discriminating website must meet to become Title III compliant.
